In 2022 the Agency for Protection and Development of Competition monitored the activities of a group of companies of JSC "National Company "Kazakhstan Temir Zholy" for the approval of the antimonopoly authority when establishing, expanding and changing the ongoing activities. Monitoring covered 42 organizations with 424 types of activities, reports World of NAN.
"Of the 42 companies, 14 companies were not covered by monitoring, including: 7 - are not residents of the Republic of Kazakhstan, 7 - joint ventures with a share of no more than 50% of shares. Thus, 81 out of 424 analyzed activities are carried out without the approval of the Agency. In this regard, to eliminate the identified violations, the Agency has issued 19 injunctions to KTZh and its affiliated companies to stop violating the legislation on protection of competition, "- commented in the APDC.
In particular: KTZh, JSC "Kedentransservice", LLP "Militarized Railway Security", LLP "Transport Holding Kazakhstan", JSC "KTZh Express", LLP "KTZh EXPRESS SHIPPING", JSC "Temirzholsu", LLP "KTZh-Cargo Transportation", LLP "KTZh-Passenger Locomotives", LLP "Port Kuryk" ordered to stop performing unauthorized activities, or approve them in the prescribed manner.
Similar work was carried out in the regions, where 251 state enterprises of the social sphere were monitored. Within the framework of the monitoring in the actions of 59 subjects were found violations and orders to stop violations were sent.
The APDC reminds that pursuant to Article 192 of the Entrepreneurial Code the approval of the antimonopoly body is required for expansion and (or) changes in the activities of state enterprises, legal entities where more than fifty percent of shares (equity interests) are owned by the state, and their affiliates who will operate in the Republic of Kazakhstan.
