Preliminary damage from gray imports of grain amounted to 660 million tenge

Andrey Lukin, deputy of the Senate of the Parliament, during his inquiry to the Minister of Finance Yerulan Zhamaubayev has voiced the problem of budget shortfalls due to grain smuggling, World of NAN reports.

Law enforcement agencies have confirmed the scheme of illegal import of wheat under fictitious documents, and only preliminary damage to the state in the form of unpaid VAT from the imported goods from Russia to Kazakhstan amounts to more than 660 million tenge.

"This indicates the use and entrepreneurs of the two countries of the scheme to obtain benefits from the VAT by exporting Russian grain under the guise of being from Kazakhstan, "- said the deputy.

The reason for this state of affairs is the lack of a system of accounting and further control of the use of imported from Russia grain products.

"The problem of economic smuggling is very relevant in terms of its correct identification. The Criminal Code defines the concept of economic smuggling as the movement of goods across the customs border by concealment from customs control, or with fraudulent use of documents, or associated with their non-declaration or indication of deliberately false information in the application for the release of goods. The intent in committing them is aimed solely from payment of customs duties. At the same time, for evasion criminal liability also arises under another article of the Criminal Code - 236. Thus, the criminal legislation for one criminal intent provides for two different types of criminal offenses. And if in one case we confiscate the goods, in the other case we return them after paying the required fees," said the senator.

Hence there is an urgent need for legislative intervention in this situation through amendments aimed at distinguishing smuggling from evasion.

To resolve the above issues, it is proposed to distinguish between criminal offenses of smuggling and evasion, to digitize the process of accounting and control of imported goods from EEU countries and strengthen the control of the State Revenue Committee to prevent the shadow export of goods.
