The land department deliberately does not extend the lease to Pavlodar farm

The Council on Protection of Entrepreneurs' Rights and Counteraction to Corruption of Pavlodar Regional Chamber "Atameken" reviewed the problem of the farm "Gryaznovka" at its meeting. It turned out that the department of land relations of Aksu illegally refused to prolong the land lease agreements to the farm, World of NAN reports.

According to the press service of Atameken, the department ignored the order of the Department of Land Resources Management of Pavlodar region.

According to information of Gryaznovka farm, the representatives lodged a complaint to the department of land resources management of Pavlodar region about the illegal refusal to extend the lease agreements. On this complaint the Department conducted an inspection of the land relations department of Aksu.

On March 10, the farm "Gryaznovka" applied to the department of land relations of Aksu to extend the lease agreements. At that time the deadline for the lease agreements should have expired on May 10, 2022. That is, the farm duly fulfilled its obligations under the terms of the renewal of the lease agreements without violating the term of the application. But on March 30, 2022, the land commission refused to grant the land for temporary land use.

"During the inspection of this complaint it was found that there was no evidence of non-use of the land plots for their intended purpose. In addition, the use of these land plots for their intended purpose is confirmed by information from the website agro.garysh.kz. This means that the unlawful refusal to allocate the land violated the rights of the farm "Gryaznovka", - was stated in the Chamber of Entrepreneurs of the Pavlodar region.

According to the results of the inspection, arranged by the Department of Land Management of the Pavlodar region, Aksu land department issued an order to eliminate violations of land legislation, namely to provide these plots for a new term. But the Aksu land department ignored this prescription and has still not fulfilled it, so the department was forced to go to court.

The decision of the land commission dated March 30, 2022 was not presented to the farm for their information.

As a result of its meeting, the Council on Protection of Entrepreneurs' Rights and Counteraction to Corruption of the Chamber of Entrepreneurs of the Pavlodar region recommended to send a copy of the decision and materials on this appeal to the Prosecutor's Office of the Pavlodar region, the Department of Land Resources of the Pavlodar region and the Aksu city Akimat for review.
