Akimat illegally takes land from the farmer

Back in 2019 the head of the farm "Arystan" Kalamkas Dauletov purchased a land plot for farming, and at the end of last year the local akimat suddenly decided to confiscate it, World of NAN reports with reference to the Chamber of Entrepreneurs.

The residents of Petrovka village of Yesil district of North Kazakhstan region began to revolt because of the lack of pastures. They appealed to the regional prosecutor's office and wrote a complaint against the farm. The akim of the rural district held a meeting of residents, where a decision was made to confiscate land from the farm.

"According to article 84 of the Land Code of the RK the land can be compulsory alienated for state needs only in exceptional cases with the consent of the owner or non-state land user or by a court decision", - explained the head of the Department on Protection of Businessmen Rights of CE NKR Aidos Kenbeilov.

The list of such cases does include meeting the needs of the population in pastures for grazing livestock of private farmsteads. However, these pastures should be included in the Pasture Management and Use Plan, as well as reflected in a separate annex - in the Map with the external and internal boundaries and areas of pastures. But the lands of peasant farm are not included in this plan, and the alienation of land is illegal. It was even acknowledged by the prosecutor's office and a corresponding ruling was issued.

But, according to the Head of Department of Land Relations of Yesil region Yevgeniy Gub, the seizure procedure will start on June 10, 2023, accordingly they have time to include this plot into the plan of pastures.

At the same time, the district akimat can't provide the entrepreneur with an equivalent plot as an alternative, since it simply doesn't exist, but it is ready to compensate him.

Representatives of the regional land inspectorate issued a prescription to the district akimat to cancel the decision on the compulsory seizure of the land plot of the farm. But the akimat of Yesil district intends to appeal this prescription in court.
