Officials to be fined for violation of land legislation

The Senate adopted in two readings the amendments and additions to the Code of Administrative Offences. The document provides for improvement of state control over the use and protection of land, as well as increasing responsibility, reports World of NAN.

According to the press service of the Ministry of Agriculture, the amendments to the legislation contain provisions to establish liability of akimat personnel for violation of requirements and imposing fines. Thus, in the case of violations, officials face a fine of 30 MCI.

In particular, it is prohibited to grant the right of private ownership and land use of agricultural land to foreigners, stateless persons, foreign legal entities, legal entities of Kazakhstan with foreign participation, international organizations, scientific centers with foreign participation, as well as kandas (repatriates), citizens of our country married to them.

Also, granting the right of private ownership and the right to use of pasture land is also prohibited. Liability also awaits for the provision of citizens and non-state legal entities in private ownership and land use areas used and intended for the needs of the population, including occupied hayfields within the boundaries of cities of regional and district values, villages or rural settlements.

Now akimats will also be required to place and quarterly update information on vacant land plots and planned tenders (auctions) on the web-portal of the State Register, online resources and special information boards in places accessible to the public.

Land users will be obliged to notify the authorized body of the transaction on the alienation of the right to agricultural land with another land user. Liability is also stipulated for violation of fertile soil layer, not only for its sale or transfer to another person, but also for destruction or illegal removal of fertile soil layer.

It should be noted that the functions of state control over the use and protection of land have been fully transferred from the akimats to the Ministry of Agriculture.
