A farmer went bankrupt because of fraudsters and negligence of government agencies

For five years the Dil-Nar-Ai farm from the Pavlodar region has been trying to prove its innocence in the courts. The farm first bought cattle from fraudulent companies without knowing about it. Then, having received subsidies from the state, it became obliged to pay them back. The farm cannot operate because the accounts and the property have been seized, World of NAN reports quoting Atameken.

Four years ago, the start-up farm received a loan of 46 million 875 thousand tenge under the state program Sybaga. When the farm applied for it, the head Gulzhanat Akhmetova was promised to give an agent for finding a cattle for the purchase. But they never did. They searched on their own. Russian regions were closed to quarantine because of foot-and-mouth disease. The regional territorial inspectorate refused to allow them to bring in livestock from these regions. The farm came to the decision to return the money taken on credit back. But the credit partnership "Bayanaul" refused, explaining that the money would have to be returned with penalties, paying an additional 25% of the amount. Start-up farmers do not have such money.

After the Department of Agriculture (DA) of Pavlodar region presented supplier M., who imports cattle from Russia to Kazakhstan. Pavlodar agrarians made an agreement with him and went to inspect the cattle in Kemerovo region. In March 2019, after the quarantine, the same M. brought them cattle from Russia with all the necessary documents. The Dil-Nar-Ai farm settled accounts with him.

The Department of Agriculture and the regional veterinary service checked all the documents and registered the cattle. Then representatives of the Republican Chamber of the Kazakh white-headed breed arrived from the capital to verify the purity of the animals. They made boning and issued documents, which the farm submitted to the regional agricultural administration.

Dil-Nar-Ai applied for subsidies for breeding purebred cattle. DA paid to the farm investment subsidies: 175 thousand tenge for each cow - a total of 13 million 150 thousand tenge. Agrarians transferred this money to the account of the credit partnership Bayanaul, as it should be according to the contract.

But in 2020 Dil-Nar-Ai and four other farms from Bayanaul district were summoned to the Department of Economic Investigations. There they were confronted with the fact that the papers on the animals purchased from M. were false. The investigation found out that seven other farms in the region had bought cattle from M.. He himself confirmed that he had also brought animals for the Dil-Nar-Ai farm. He was found guilty in court.

Then the Department of Agriculture went to court with a lawsuit against all the farms that had bought animals from the swindler, and demanded the return of the subsidies. The argument was the delivery of cattle under forged documents. According to the farmers, they, as ordinary farmers, could not verify the authenticity of the documents, because they are not experts in this. It was up to the state authorities to verify the originality of the documents. It took a year for the court proceedings.

Dil-Nar-Ai and Dastarkhan lost the trial. After the support of representatives of the deputy office, "Dastarkhan" won the appeal process and received money for the interest on the loan. Seven other farms found themselves in the same situation. Lawsuits were withdrawn from all, except for the Dil-Nar-Ai farm. It lost the court of appeal.

Now the farm has to pay to the state about 20 million tenge on the claim of the DA and the interest rate. For a year the farm has been paying the loan without repayment of the interest rate. Its property and all accounts are under arrest, and its credit history is ruined. Even the funds that were in the account were seized to the state. There is nothing to pay the salaries of the employees of the farm.

The hopelessness of the situation is aggravated by the fact that now, during the wintering period, the cattle have begun calving and the stock of fodder is coming to an end. And in the meantime, bailiffs want to seize the animals. The business entity is exhausted by inspections and driven to despair.

"Now Dil-Nar-Ai is preparing for the court of cassation", says Zhomart Sembayev, deputy director of the Pavlodar Regional Chamber of Entrepreneurs.
